These Terms govern your use of the Rising Sun Sober Living website, online application, and payment portal. They do not replace the separate House Rules and Resident Agreement that residents sign at move-in, which control the residency relationship. This page is maintained by Rising Sun Sober Living and is provided for general informational purposes only. It is not legal advice. For advice specific to your situation, consult a licensed attorney in your state.

1. Acceptance

By accessing risingsunsoberliving.com or submitting an application or payment, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.

2. Who We Are

Rising Sun Sober Living ("Rising Sun," "we," "our," or "us") operates sober-living homes across Idaho. Mailing address: 8050 W. Ustick Road, Boise, ID 83704. Contact: admin@risingsunsoberliving.com · (208) 898-4668.

3. Eligibility

You must be at least 18 years old to apply for housing or make a payment. By submitting information, you confirm that the information is accurate and that you are authorized to provide it.

4. Application Process

Submitting an application does not guarantee acceptance. We review every applicant and reserve the right to accept or decline at our discretion to the extent permitted by law, including based on house availability, background, and fit with the program. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, or any other class protected by the federal Fair Housing Act, the Americans with Disabilities Act, or applicable state law.

4a. Not a Treatment Facility; No Medical Care

Rising Sun Sober Living provides peer-supported sober housing only. We are not a hospital, detox center, mental-health facility, licensed treatment program, clinical provider, or emergency-response service. We do not diagnose, treat, prescribe, or supervise medical or psychiatric care. Residents are responsible for their own medical, mental- health, and medication-assisted-treatment decisions and for engaging qualified outside providers. If you are in crisis or experiencing a medical emergency, call 911 or 988 (Suicide & Crisis Lifeline).

4b. No Guarantee of Recovery Outcomes

Recovery outcomes depend on many factors outside our control. We make no representation, warranty, or guarantee regarding sobriety, relapse prevention, employment, housing stability, reunification, parole/probation outcomes, or any other personal result. Testimonials reflect individual experiences and are not promises of similar results.

5. Payments

  • Payments are processed by Stripe. We do not store full card numbers. A service charge of 3% + $0.30 is added at checkout.
  • All payments to Rising Sun Sober Living are non-refundable except where a refund is required by applicable law. By submitting a payment you confirm that you understand and accept this.
  • You are responsible for ensuring the payment information you submit is accurate and that you are authorized to use the payment method.
  • Disputes or chargebacks initiated without first contacting us may result in loss of housing and additional fees to the extent permitted by law.

6. House Rules

Residents are required to follow the House Rules and Resident Agreement provided at move-in, including curfew, drug-test, and behavior requirements. Violations may result in immediate removal from housing without refund, subject to applicable Idaho landlord-tenant, recovery-residence, and consumer-protection laws.

The current House Rules (effective December 5, 2025) are available as a PDF: Download the Rising Sun Sober Living House Rules (PDF). By signing the Resident Agreement at move-in, you acknowledge that you have read, understood, and agreed to follow this document in full.

7. Electronic Communications (Email, SMS, TCPA)

By providing your phone number or email, you consent to receive communications from Rising Sun about your application, residency, payments, and program updates, including by automated means. Message and data rates may apply. For SMS, reply STOP to opt out or HELP for help. You may opt out of marketing email at any time using the unsubscribe link. Consent to marketing messages is not a condition of housing or services. We comply with the federal CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA).

8. Information Sharing with IDOC

Residents enrolled through the Idaho Department of Correction re-entry program understand that Rising Sun may share status, attendance, drug-test results, and incident reports with IDOC staff and assigned parole/probation officers as a condition of residency.

9. Website Content

All content on this website — text, photos, logos, and graphics — is owned by Rising Sun Sober Living or used with permission. You may not copy, republish, or use the content commercially without written permission. To report copyright infringement under the Digital Millennium Copyright Act (DMCA), email admin@risingsunsoberliving.com with the URL of the material, your contact information, and a good-faith statement of infringement.

10. Third-Party Services

The site links to and uses third-party services (Stripe, Google, email providers). Their terms and privacy policies govern their services. We are not responsible for the content or practices of third-party sites.

11. No Medical or Legal Advice

Rising Sun provides housing and peer support. We are not a medical, clinical, or legal services provider. Information on this site is for general purposes only and is not a substitute for professional advice.

11a. Accessibility

We strive to make this website accessible to all users and aim to follow WCAG 2.1 AA guidance. If you encounter an accessibility barrier, please contact us at admin@risingsunsoberliving.com and we will work to provide the information or service through an alternate channel.

11b. User Conduct

  • You will not submit false, misleading, or fraudulent information.
  • You will not use the site to harass, threaten, or defame any person.
  • You will not attempt to access non-public areas, accounts, or systems.
  • You will not interfere with the site's security, performance, or features.
  • You will comply with all applicable federal, state, and local laws.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO THIS EXCLUSION MAY NOT APPLY TO YOU.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RISING SUN SOBER LIVING AND ITS OWNERS, EMPLOYEES, HOUSE MANAGERS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE, APPLICATION PROCESS, OR PAYMENT PORTAL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THIS WEBSITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO US THROUGH THE WEBSITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Carve-out: Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, fraud, personal injury caused by our negligence, wrongful death, statutory consumer protections, or violations of civil-rights or housing- discrimination laws. Some U.S. states do not allow limitations on incidental or consequential damages, so portions of this section may not apply to you.

13a. Assumption of Risk (Site Visitors)

You acknowledge that recovery housing involves inherent risks including, without limitation, the actions of other residents, relapse, and exposure to recovery-related content. To the fullest extent permitted by law, you assume those risks when interacting with our website, programs, or properties as a non-resident visitor. This section does not waive rights of residents under their Resident Agreement or under Idaho landlord-tenant law.

13b. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Rising Sun Sober Living and its owners, employees, and contractors from any third-party claim, loss, or expense (including reasonable attorneys' fees) arising from (a) your violation of these Terms, (b) your misuse of the website, or (c) your violation of any law or third-party right. This obligation does not apply to claims caused by our own gross negligence or willful misconduct.

13c. Informal Resolution First

Before filing any formal claim, you agree to first contact us at admin@risingsunsoberliving.com and give us thirty (30) days to attempt to resolve the dispute in good faith. Most issues can be resolved this way.

13d. Binding Arbitration & Class-Action Waiver

Where permitted by law, any dispute arising out of or relating to your use of this website that is not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Ada County, Idaho. You and Rising Sun waive any right to a jury trial and to participate in a class, collective, or representative action.

Carve-outs: (a) Either party may bring an individual claim in small-claims court; (b) either party may seek injunctive relief in court to protect intellectual property; (c) claims that cannot be arbitrated under applicable law are excluded; and (d) you may opt out of arbitration within 30 days of first accepting these Terms by emailing the address above with the subject line "Arbitration Opt-Out."

Severability / state-by-state: If a court of competent jurisdiction (including in California, New Jersey, New York, Massachusetts, Illinois, Washington, or any other state) finds the arbitration provision or class-action waiver unenforceable as applied to a particular claim or resident, that claim shall proceed in court while the remainder of this Section and these Terms remain in effect.

14. Governing Law & Venue

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules. Subject to Section 13d, any dispute that proceeds in court shall be brought exclusively in the state or federal courts located in Ada County, Idaho, and you consent to personal jurisdiction there. Nothing in this Section deprives you of the protection of mandatory consumer laws of your home state that cannot be waived by contract.

14a. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall remain in full force. These Terms, the Privacy Policy, and (for residents) the House Rules and Resident Agreement constitute the entire agreement between you and Rising Sun regarding the website and supersede any prior agreement on the same subject.

15. Changes

We may update these Terms from time to time. The "Effective" date at the top reflects the most recent change. Continued use of the site after an update means you accept the revised Terms.
